Under Arizona law, criminal damage can be charged as a felony or misdemeanor depending on the circumstances of your case. These charges can have a substantial impact on your future. Arizona law defines criminal damage as recklessly defacing or damaging another person’s property, tampering with another person’s property to impair its function or value, damaging a utility, drawing or inscribing something onto another person’s property without their permission, or intentionally tampering with a utility property.
PENALTIES FOR CRIMINAL DAMAGE
Penalties for criminal damage are based on the value of the property. This means if the property is valued at …
- Less than $250, a Class 2 misdemeanor, you can spend up to four months in jail.
- $250 to $1,000, a Class 1 misdemeanor, you can spend up to six months in jail.
- $1,000 to $2,000, a Class 6 felony, you can spend up to one year in jail or prison.
- $2,000 to $10,000, a Class 5 felony, you can spend up to 18 months in jail or prison.
- More than $10,000, a Class 4 felony, you can spend up to 2.5 years in prison.
- $5,000 or more for intentional damage to a utility, a Class 4 felony, you can spend up to 2.5 years in prison. (This is also considered aggravated criminal damage.)
There are a number of factors that the courts consider when determining the amount of damage caused. These factors include:
- How much it would cost to replace the item?
- How much it would cost to repair the property?
- The labor required to repair the property.
- The cost for the materials.
- Cost of equipment necessary to make the repairs.
