Under Arizona law, misconduct involving a weapon is extremely serious and can be found at A.R.S. 13-3102. Possible Penalties for Misconduct Involving Weapons
If it is charged as a Class 3 Felony:
- Up to 8.75 years in prison
- Up to 5 years of supervised probation;

- Up to 3.75 years in prison;
- Up to 4 years of supervised probation;
- Up to $150,000 in court fines plus surcharges.
If it is charged as a Class 6 Felony:
- Up to 2 years in prison;
- Up to 3 years of supervised probation;
- Upt to $150,000 in court fines plus surcharges.
If it is charged as a Class 1 Misdemeanor;
- Up to 6 months in jail;
- Up to 3 years of supervised probation;
- Up to $2,500 in court fines plus surcharges.
If the State charges you with possessing or using a deadly weapon during the commission of the offense it will substantially increase the potential punishment. In addition to prison/jail time, probation and fines, if your case results in a felony conviction you will lose certain civil rights.
