When someone is stopped and cited for Criminal Speed in Phoenix, they often don’t think that it’s a big deal, and believe that it’s just a traffic ticket. However, under Arizona law, criminal speed is a Class 3 Misdemeanor, therefore, a conviction could have a substantial impact on your life.

There are three circumstances when someone can be charged with criminal speeding under Arizona law.

Excessive Speed (28-701.02a3)

This is the criminal speed most commonly charged. To be charged under this statute the State will have to prove that you exceeded the posted speed limit by more than 20 miles per hour.

Exceed the posted speed limit in a business or residential district by more than twenty miles per hour, or if no speed limit is posted, exceed forty-five miles per hour. (28-701.02a2)

This is also commonly charged and is usually seen in more urban parts of Arizona in the major cities. This violation occurs if a person exceeds the posted speed limit in a business or residential district by more than twenty miles per hour, or if no speed limit is posted, exceeds forty-five miles per hour. Some examples include:

Traveling 56 miles per hour or above in a 35 mile per hour zone
Traveling 66 miles per hour or above in a 45 mile per hour zone
Traveling 76 miles per hour or above in a 55 mile per hour zone

Exceeding 35 miles per hour near a school zone (28-701.02a1)

This violation must occur in a designated school zone, which generally includes having signs posted.

POSSIBLE PENALTIES FOR A CRIMINAL SPEED CONVICTION

Someone convicted of criminal speed in Arizona could face the following penalties:

Up to 30 days of jail
A fine of up to $500 plus surcharges
Up to 1 year of probation.

Additional penalties could include:

Adding 3 points to your drivers license
Limitation on employment opportunities due to driving record
Impact on immigration status
Impact on insurance rates
Driver’s license suspension
Disqualification of commercial driver’s license status (CDL)
