The crime of identity theft is covered in Arizona Criminal Code § 13-2008 and is designated a class 4 felony. A conviction comes with a presumptive term of 2.5 years in prison and often requires restitution.

Under A.R.S. §13-2310, a fraudulent scheme involves knowingly obtaining a benefit through false pretenses, representations, promises, or material omissions. This includes schemes designed to deprive someone of money, property, or the intangible right to honest services.
Fraudulent schemes are classified as a Class 2 felony. A first-time offender may face probation or 3 to 12.5 years in prison. With prior felony convictions, sentencing can range from 4.5 to 35 years. If the benefit exceeds $100,000, prison is mandatory and probation is not an option.
